Phoenix distinguishes a written interpretation, a case-specific code modification and an appeal of an enforcement decision. Identify the exact provision, decision and project facts, then use the applicable Planning and Development request process. A modification must preserve the code’s protected requirements; filing a request is not permission to disregard a correction or a guarantee of approval.
When is an interpretation appropriate?
A written interpretation asks how a code requirement applies to a specific situation. The Phoenix provision calls for a written request on the department's form, information or calculations describing the circumstances, and the applicable fee. The building official's decision is recorded in department files.
Ask Planning and Development for the current form and submission instructions. State the disputed wording and the proposed application, with drawings or other supporting information. An informal conversation can help identify the question, but keep the actual formal response with the project records before relying on it.
What is a modification for practical difficulty?
A modification addresses an individual case where special circumstances make the strict letter of the requirement impractical. Under Section 104.2.4.3, it must remain consistent with the code's intent and purpose and cannot lessen health, accessibility, life and fire safety or structural requirements.
The applicant supplies substantiating information. The building official can approve, approve with stipulations or deny the request, and may require compensating alternate methods or systems. A preference for a cheaper fixture is not an approval, and another project's modification does not automatically cover this property.
If the proposal concerns a different material or construction method, review the separate alternative-approval workflow with the department.
How does an appeal differ?
The adopted procedure allows review of an employee's enforcement decision by the supervisor or designee, followed by a written appeal to the building official under the stated process. It also provides an appeal of the building official's decision to the Development Advisory Board under Section 113.
Confirm the appropriate stage, current form, fee and any procedural deadline with the department. Preserve the original decision, your request, evidence and resulting determination.
