What are the federal notification clocks?
Under 40 CFR 403.12(g)(2), an industrial user's sampling that indicates a violation requires notification to the control authority within 24 hours of becoming aware of it. The user also repeats sampling and analysis and submits the repeat-analysis results within 30 days after awareness. That is a results-submission deadline, not merely a date to book the laboratory.
The rule contains resampling exceptions when the authority samples at least monthly or samples between the original collection and receipt of its results. It also addresses sampling done by the authority in place of the user. Confirm the applicable exception with the authority; an older inspection or a contractor's opinion is not enough. What should you report and investigate?
Use the actual laboratory result, with its pollutant, units, sampling point, collection period and applicable permit limit. Record the awareness time, contact method, recipient and instructions received. Ask whether the event also requires an immediate potential-problem or spill notice; a harmful discharge has a different urgency from routine report preparation.
Investigate without rewriting the original data. Possible questions include whether the sampled stream was correct, whether production or cleaning changed, and whether pretreatment equipment operated as intended. A sampling question must be resolved with the laboratory and authority; it is not permission to discard an unfavorable result.
How do you organize repeat sampling and repairs?
Assign a person to each task:
